Terms and Conditions of Sale and Installation

a. “Conditions” means these Terms and Conditions of Sale and Installation.

b. “Customer” means the person, company, or entity to whom the quotation or invoice is addressed.

c. “Products” means all custom-made blinds, curtains, shutters, awnings, and related products or services supplied by Monalisa Window Fashions.

d. “Quotation” means the written quotation or proposal issued by Monalisa Window Fashions to the Customer in conjunction with these Conditions.

e. “Monalisa Window Fashions” means Monalisa Window Fashions, ABN 82 692 208 389.

These Conditions form part of every quotation and contract for the supply of Products and installation services by Monalisa Window Fashions. By accepting a quotation, the Customer agrees to be bound by these Conditions.

Prices quoted are valid for thirty (30) days from the date of quotation unless otherwise stated in writing. This does not apply to limited-time promotions or special offers.

All quoted prices are inclusive of GST, unless otherwise stated.

Upon receipt of acceptance, Monalisa Window Fashions reserves the right to review and adjust quotations for clerical errors, measurement discrepancies, or unforeseen costs relating to manufacturing or installation.

a. A 50% deposit is required to confirm the order.

b. The remaining balance must be paid at the time of installation or collection, unless otherwise agreed in writing.

c. All finance-approved orders must be settled in full at the time of ordering.

d. Accepted payment methods include cash, EFTPOS, Visa, Mastercard, and bank transfer (a surcharge may apply to credit card transactions).

a. All orders are Cash on Delivery (COD) unless a prior credit arrangement exists.

b. Any additional costs incurred due to Customer delays, access issues, or variations will be charged to the Customer.

c. In the event of late or non-payment, Monalisa Window Fashions reserves the right to charge interest, legal fees, and debt collection costs.

8. Cancellation or Modifications

Once an order is confirmed and a deposit paid, it cannot be cancelled or altered without written consent. Any modification or cancellation will incur costs equivalent to any expenses already incurred.

Ownership of all Products remains with Monalisa Window Fashions until full payment has been received. Products may be removed from site if payment is not made as agreed.

a. All Products carry a three (3) year limited warranty from the date of installation.

b. This warranty covers manufacturing defects only and excludes normal wear and tear, fading, or damage caused by misuse, neglect, or improper maintenance.

c. The warranty applies only to fully paid orders.

a. The Customer must ensure clear and safe access to the installation area (minimum 1 metre clearance).

b. Monalisa Window Fashions accepts no responsibility for existing structural imperfections or damages during the removal of old coverings.

c. Installations above three (3) metres in height may incur additional charges for ladders, scaffolding, or safety equipment.

d. If the Customer provides incorrect measurements, any required modifications or replacements will be at the Customer’s expense.

Due to manufacturing processes, minor variations in colour, texture, and grain may occur between batches. These are not considered defects.

Where the Customer requests Monalisa Window Fashions to hold completed goods, free storage will be provided for up to 30 days after the order is ready. A 10% monthly storage fee applies thereafter.

Monalisa Window Fashions is not liable for indirect or consequential loss, damage, or delays arising from causes beyond its control, including material shortages, shipping delays, or weather conditions.

It is the Customer’s responsibility to confirm the final selection of fabrics, colours, and styles. Monalisa Window Fashions accepts no responsibility for Customer colour or fabric choices once the order is in production.

Installations will be conducted during normal business hours (7am–6pm Monday to Friday, 7am–4pm Saturday) unless otherwise arranged.

Customers must ensure the site is safe and accessible for installers.

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of New South Wales, and both parties agree to submit to the non-exclusive jurisdiction of NSW courts.
